OFFICIAL RULES
NO PURCHASE OF ANY KIND OR WIRELESS MESSAGE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR WIRELESS MESSAGE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Star Gazing Sweepstakes begins on January 30, 2009 and ends at 11:59 p.m. ET on March 15, 2009 (the "Promotion Period"). All entries must be received by 11:59 p.m., ET on March 15, 2009.
SPONSOR: Meredith Corporation, 1716 Locust St., Des Moines, Iowa 50309-3023 (hereinafter referred to as "Sponsor").
ELIGIBILITY: Entrants must be legal residents of the 50 United States or the District of Columbia, and at least 21 years of age at time of entry. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months performed services for Sponsor, SpyderLynk, LLC, or any organizations responsible for sponsoring, fulfilling, administering, advertising and promoting the sweepstakes and/or supplying the prizes, and their respective parents, subsidiaries, affiliated and successor companies, and the immediate family members and household members, whether related or not, of such individuals, are not eligible to enter or participate in the sweepstakes. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses and their respective spouses, regardless of where they reside. "Household members" shall mean people who share the same residence at least three months a year. Void where prohibited. Sweepstakes is subject to all applicable federal, state and local laws.
DURING THE PROMOTION PERIOD, THERE ARE TWO (2) WAYS TO ENTER:
(1) Online entry: Visit www.familycirclepromo.com and follow the directions provided to submit a completed online entry form; OR
(2) Wireless entry: If you are a wireless service subscriber and have a multimedia messaging service (MMS) capable device, look for the Star Gazing interactive logo in the March 2009 issue of Family Circle magazine. Use your mobile device to take a picture of the logo and send by MMS message to 949-331-8147 or the email address fc@snaptag.mobi. You will be charged standard MMS and data rates for each MMS message sent or received from your handset according to your service agreement with your wireless carrier. Each wireless carrier's rate plan may vary, and entrants should contact their wireless carrier for information on messaging rate plans and charges relating to your participation in this sweepstakes. Any MMS message form of entry into this sweepstakes will be deemed made by the named account holder whose mobile phone number is assigned at the time of entry to the mobile messaging device so used.
Any attempt by any participant to obtain more than one (1) entry by using multiple/different phone numbers, email addresses, mailing addresses, identities or any other methods will void all of that participant's entries. Limit one (1) entry per person, per email address or wireless phone number, regardless of method of entry. Entries received from any person or email address or wireless phone number in excess of the stated limitation will be void.
Sponsor, in its sole discretion, reserves the right to add or delete a wireless carrier at any time, without notice.
Entry into the sweepstakes constitutes entrants' consent to participate in this sweepstakes. Online entry constitutes entrant's consent for Sponsor to obtain and deliver entrant's name, address and other information to SpyderLynk, LLC, for the purpose of administering this sweepstakes and for other uses by Sponsor as permitted by applicable law. Entries become the property of Sponsor and will not be acknowledged or returned. Released Parties (as defined below) are not responsible for lost, late, stolen, incomplete, misaddressed, garbled, undelivered or misdirected online entries or MMS messages.
WINNER SELECTION: On or about April 15, 2009, a random drawing from among all eligible entries received will be conducted under Sponsor's supervision.
ODDS of winning depend upon the number of eligible entries received.
PRIZES: One (1) winner will receive a flat screen television, approximate retail value $1,000. Brand and model of flat screen television will be determined by Sponsor in its sole discretion. The prize will be delivered approximately thirty (30) days from date of winner verification. Sponsor reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. Sponsor will determine all elements of prizing in its sole discretion. Prize may not be assigned, transferred, changed, substituted or redeemed for cash, except at Sponsor's sole discretion. Prize is awarded "as is" with no warranty or guarantee express or implied by Sponsor. Sponsor disclaims all and any liability for the actual provision, quality or nature of any third-party product or service accepted by the winner. The awarding of any prize is contingent upon full compliance with these Official Rules. All federal, state and local taxes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided by Sponsor will be the sole responsibility of the winner.
Sponsor, SpyderLynk, LLC, or any organizations responsible for sponsoring, fulfilling, administering, advertising and promoting the sweepstakes and/or supplying the prizes, and their respective parents, subsidiaries, affiliated and successor companies, and each of their respective employees, officers, directors, agents and shareholders (collectively, the "Released Parties") are not liable for injuries, losses, or damages of any kind to persons, including death, or property, arising in whole or in part, directly or indirectly, from entrant's participation in this sweepstakes or acceptance, possession, misuse or use of a prize. Released Parties are not responsible for errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical or other error in the printing or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors or difficulties which may occur with the administration of the sweepstakes, the processing of online entries or MMS messages, the announcement of the prizes or in any other sweepstakes-related materials. Decisions of Sponsor are final and binding in all respects.
If a potential winner submitted an online entry, the winner notification will be sent by U.S. Mail. If a potential winner submitted an MMS message entry, the winner notification will be sent via SMS text message to potential winner's wireless device from the Sponsor. Regular carrier charges for SMS messages or mobile telephone calls may apply in connection with notifications from Sponsor. During the Promotion Period, Sponsor, at its discretion, may send entrants unlimited additional notifications regarding the sweepstakes. Entrants will be charged standard carrier-specific text-message or call rates, depending on entrants' individual wireless or non-mobile pricing plans, for these additional notifications. There is no limit as to the number of notifications the Sponsor may send during the eligibility period or restriction on when notifications may be sent. If you do not want to receive further notifications, send an SMS message to 949-331-8147 with the message "STOP" from the wireless device you used to enter. If you submit a wireless entry, you agree to have your home phone number information remain on SpyderLynk databases. Sponsor is not responsible for any and all communication between SpyderLynk and wireless entrant that relates to this sweepstakes and for any and all communications regarding future promotions.
PRIVACY: By entering and providing the required entry information, you acknowledge that Sponsor may also send you information, samples or special offers it believes may be of interest to you about its publications or other complementary goods offered by Sponsor. Information collected from online entrants is subject to Sponsor's online privacy policy at www.familycircle.com. IF YOU DO NOT WISH TO SHARE YOUR INFORMATION, PLEASE DO NOT ENTER THIS SWEEPSTAKES.
DISPUTE RESOLUTION: Except where prohibited, by participating in this sweepstakes, entrants agree that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of New York without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this sweepstakes, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of New York and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this sweepstakes, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this sweepstakes, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this sweepstakes but in no event will entrant be entitled to attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
GENERAL: If for any reason this sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, the Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes, at which time Sponsor reserves the right to conduct a random drawing from among all eligible, non-suspect entries received at the time of the sweepstakes cancellation or termination. Released Parties are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, or for miscommunications or communications line failure, lines, cell towers, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or for theft, destruction or unauthorized access to, or alteration of, entries or MMS messages. Released Parties are not responsible for any problems or technical malfunctions of any telephone network or telephone lines, cable, satellite, computer on-line systems, for lost, interrupted or unavailable networks, servers, providers, website, or other connections, computer equipment, software, failure of any entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer or mobile device relating to or resulting from participating in this sweepstakes or downloading any materials in this sweepstakes. RELEASED PARTIES ARE NOT RESPONSIBLE FOR INCOMPATIBILITY OF ENTRANT'S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR'S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST ETENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of a potential winner based on an email address, the potential winning entry will be declared made by the "Authorized Account Holder" of the email address submitted at time of entry and such person must comply with these Official Rules. "Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. In the event of a dispute as to the identity or eligibility of a potential winner based on a wireless phone number, the potential winning entry will be declared made by the "Authorized Account Holder" of the wireless phone number at the time of entry will be deemed to be the entrant and must comply with these Official Rules. "Authorized Account Holder" is the natural person who is assigned the wireless phone number by wireless service provider responsible for assigning that wireless phone number. Use of script, macro or other automated devices are not valid for entry and all such entries will be void. Sponsor may ask any entrant or potential winner to provide Sponsor with proof that such party is the authorized account holder of the email account or wireless phone number associated with the entry.
Except where prohibited by law: (i) entry constitutes permission for Sponsor and its designees to use winners' entry, name, hometown, voice, likeness, photograph and any statements regarding this sweepstakes for editorial, public relations, promotional and advertising purposes in any and all media now known or hereafter devised, worldwide in perpetuity, without compensation, notification or permission; (ii) potential winners will be required to complete and return an Affidavit of Eligibility, Release of Liability/Publicity, and W-9 form within ten (10) days of date of notification or, at Sponsor's sole discretion, such winner may be disqualified and an alternate winner may be selected by random drawing. If prize or prize notification is returned as undeliverable, potential winner is not in compliance with these Official Rules, or Sponsor is unable to contact a potential winner within a reasonable time period, such winner may be disqualified and an alternate winner may be selected by random drawing, at Sponsor's sole discretion. Winner will receive an IRS Form 1099 for the retail value of the prize.
